General conditions of sale and use of the Acupuncture3D software 

Purpose:  The purpose of this document is to present the general conditions for the sale and use of the Acupuncture3D software marketed by SAS Chan Ly sise 20 rue de Rochonen, QUINTIN (22800). 

By purchasing the software, the subscriber acknowledges having read, understood and accepted, expressly and in their entirety, the present general conditions.

Preamble:  The use of any software purchased on this site is subject to the terms and conditions set forth herein.  All software is downloaded automatically.  Payment is immediate. The pictures and illustrations have no contractual character.  The list of product functions is displayed for information only.  Despite all the care taken in its production, typographical errors, inaccuracies or omissions may affect the quality of the information presented by this software.  

Consequently, users are solely responsible for, and must retain the utmost vigilance in the operation, utilization and interpretation of the information provided; the authors cannot be held responsible for any errors or omissions in the material presented.

Orders:  Orders must be made online and may only include items presented in the catalog on this site.  Any specific request made by the buyer regarding the product can only be considered if it has been received in writing (at the site location provided for this purpose and/or by mail) prior to shipment of the products 

Delivery:  The Acupuncture3D software is delivered by download as soon as payment has been approved (immediately upon validation of payment and usually within 48 hours for orders processed manually).

Prerequisites for using the software:

In order to access all the functionalities of the Acupuncture3D software, the client must register online when the software is first launched using the identification provided on the Acupuncture3d site (email address and password) when the purchase of the software was initiated.  During the first execution, the customer must therefore ensure that he/she has a functional Internet connection available to the system on which the software is launched.

Right of withdrawal: The customer has a period of 14 days clear to exercise his/her right of withdrawal, without having to justify reasons or pay any penalties, except, if necessary, to cover any return costs.  This period is calculated from the day after the order is placed by the customer.

When this period expires on a Saturday, a Sunday or a public holiday, it is extended until the next working day.  A customer who exercises his right of withdrawal in accordance with this Article shall be refunded at the latest within thirty days of the date on which that right was exercised.  The right of withdrawal may not be exercised, in accordance with Article L121-20-2 of the Consumer Code relating to the downloading of software (in the field of the supply of services), where the execution of the downloaded software takes place, with the agreement of the customer, before the expiration of  fourteen clear days.

Responsibilities:  The buyer is solely responsible for her/his choice of the product and its suitability to his/her needs, and the seller assumes no responsibility on this point. To this end, it is the buyer's responsibility to solicit from the seller any additional information and information on the characteristics of the product or its use.  In return, the seller agrees to provide the additional information requested.   In no event shall the seller be liable for any direct or indirect damages of any kind whatsoever resulting from the misuse or inability to use the purchased product.

Modification of the general terms and conditions:   Liên Nédélec and Stéphanie Coulais reserve the right to modify the general conditions of sale and use without notice, in particular as a result of technical developments and/or legislation.

Law and jurisdiction:

Any dispute relating to the interpretation and execution of these presents will be subject to French law. The dispute thus raised shall be submitted to the court of competent jurisdiction.
